Consultation has concluded


From 5 February to 4 March 2024, comment is sought on the Voluntary Planning Agreement (VPA) relating to a Planning Agreement prepared by Metro NSWSPV 26 Pty Ltd and Willoughby City Council arising from two Class 1 appeals in the Land and Environment Court (LEC) .

The Development Applications (DA) have now been approved by the Court with agreed amendments (LEC No. - 2022.386077). These DA's as follows:

- DA-2022/228 which proposes subdivision of the land into 4 lots

- DA-2022/229 which proposes alterations and additions to the heritage item

The draft Planning Agreement will secure the completion of the heritage restoration works within an agreed timeframe and its approved scope by the developer. Also, the Planning Agreement gives Council confidence that the conservation and restoration works will occur and that the heritage dwelling will not be left in a dilapidated state. In addition, it also provides Council with some security to enforce the terms of the Planning Agreement if required.


The Council gives public notice on a draft Planning Agreement relating to this planning proposal in accordance with Clause 204 of the Environmental Planning and Assessment Regulation 2021.
