What we're doing

On 26 October 2026, Council resolved to endorse the draft Voluntary Planning Agreement (VPA) to be publicly exhibited.

From 27 October (Tuesday) to 25 November 2026 (Wednesday), comment is sought on the VPA prepared by Willoughby Projects Pty Ltd and Willoughby City Council arising from a ‘deferred commencement’ development consent granted by the NSW Land and Environment Court under DA-2024/274 for a shop-top housing development.

The 'deferred commencement' consent condition requires the execution and registration of a VPA on the relevant land title to secure the specified public benefits before the consent can become operative.

What is this VPA about

The applicant responded to the 'deferred commencement' condition requirement by submitting a draft VPA which secures:

  1. the required land dedication with its associated improvements for the widening of Stirling Lane (rear of site); and
  2. the creation and registration of a public access easement over the approved through-site link, ensuring perpetual public access and establishing ongoing maintenance obligations.

Why we are doing this

The Council is required to give public notice on the draft VPA for at least 28 days, in accordance with section 7.5 of the Environmental Planning and Assessment Act 1979 and clause 204 of the Environmental Planning and Assessment Regulation 2021.

The draft VPA can be viewed under “Document on Exhibition” below.
