The site was rezoned by the State Government on 5 March 2021 in line with Council's decision.


Background


Exhibition of amendments to Willoughby Local Environmental Plan 2012, draft amendments to Willoughby Development Control Plan and draft Voluntary Planning Agreement at 1-31 Walter St and 452-462 Willoughby Rd, Willoughby.


Amendments to Willoughby Local Environmental Plan 2012: Council has received a Planning Proposal for 1-31 Walter St and 452-462 Willoughby Rd, Willoughby. The site is currently zoned R3 Medium Density Residential under Willoughby Local Environmental Plan 2012. The Planning Proposal seeks to amend Willoughby Local Environmental Plan 2020 to:


  • rezone the site to R4 High Density Residential;
  • increase the maximum permissible floor space ratio from 0.9:1 to 1.5:1 (including 4% of gross floor area for affordable housing);
  • increase the height on 452-462 Willoughby Rd and 1-1A Willoughby Rd from 12m to 17m (approximately 5 storeys); on 3-13A Walter St from 12m to 24m (approximately 8 storeys) and on 15-31 Walter St from 12m to 27m (approximately 9 storeys);
  • amend the minimum allotment size for development of the site; and
  • include a design excellence clause.

A concept plan has been submitted indicating that the proposed planning controls could yield in the order of 255 residential units including 332 car spaces.


The Delegate for the Greater Sydney Commission has issued a Gateway Determination requiring the proposal to be placed on exhibition for 28 days. Gateway Determination does not include authorisation for Council to exercise the functions of the Minister for Planning and Public Spaces under Section 59 of the Environmental Planning and Assessment Act 1979.


Amendments to Willoughby Development Control Plan: The exhibition also includes draft amendments to Willoughby Development Control Plan (WDCP) Part D2.16 relating to the site.


Draft Voluntary Planning Agreement: Council resolved at its meeting of 20 April 2020 to prepare a draft Voluntary Planning Agreement (VPA) for 1-31 Walter St and 452-462 Willoughby Rd, Willoughby. The draft VPA seeks to secure a monetary contribution towards public works on existing / new active transport network; upgrading Willoughby Leisure Centre; and for other public purposes.


Exhibition Period: The Planning Proposal, draft WDCP amendments and draft VPA will be on exhibition from 14 May 2020 for an extended period until Monday 22 June 2020 and can be viewed here in the supporting documents section.


Exhibition Closing Date: Written submissions to be received by extended time at midnight Monday 22 June 2020 and should be addressed to the Chief Executive Officer, PO Box 57, Chatswood NSW 2057 or simply fill in the electronic submission form below.
