Comment is sought on the draft amendments ('Documents on Exhibition') to an executed Voluntary Planning Agreement (VPA) associated with the Planning Proposal (PP2017/3) and the Development Application (DA2023/256, currently under assessment), at 629-639 Pacific Highway, Chatswood.

In accordance with clause 203(5) and clause 204 of the Environmental Planning and Assessment Regulation 2021, Council gives public notice on the draft amendments to the executed VPA via a Deed of Variation.


Background

From 24 August to 21 September 2022, Council exhibited the original VPA which sought to secure a monetary contribution of $2,085,008 for funding the Community Infrastructure works under the Planning Agreement Policy & Procedures Manual, providing valuable public benefits to the Chatswood community to support the development growth resulting from the increased density at the subject site.

On 20 October 2022, the VPA was executed.


What is being exhibited?

Subsequently, the developer is seeking an amendment to the timing of instalments under the executed VPA resulting the draft VPA amendments and the Deed of Variation which is the subject exhibition. The changes to the timing of instalments (shown in italicised texts below) are proposed in the following manner:
