Re-exhibition of draft Planning Agreement

Between November 2022 and January 2023, the Council exhibited a draft Voluntary Planning Agreement (VPA) for the proposed development site at 100 Edinburgh Rd, Castlecrag.

After considering feedback during this exhibition process, the VPA has been revised.

Comment is now sought on the revised draft VPA relating to a planning proposal at 100 Edinburgh Road, Castlecrag which:

  • Increases the maximum floor space ratio (FSR) from 1:1 to FSR not exceeding 1.8:1 of which not more than 1.6:1 shall be above the level of Edinburgh Road
  • Increases the maximum building height (HOB) from 9m to height that would not exceed AHD 97.490

The Council gives public notice on the revised draft VPA in accordance with Clause 204 of the Environmental Planning and Assessment Regulation 2021.

This revision secures the following public benefits to support the development growth resulting from the increased density at the subject site:

  1. dedication of 8 car parking spaces for public use at the subject development’s commercial carpark
  2. design and delivery of works to upgrade a public pathway extending from the rear of the site to The Postern
  3. monetary contribution of $100,000 towards public artwork in accordance with Council’s Public Art Policy
  4. a public meeting room for community use located within the proposed development accessible by the public.

The contribution provided by the VPA is in accordance with the Planning Agreement Policy & Procedures Manual, and if executed, it will be applied towards works within the Castlecrag local area, providing valuable public benefits to its community.

The report which went to the Council meeting of 26 April (explaining the changes) and the initial VPA exhibited earlier this year are available under "Supporting information".

The exhibition period is between 2 May (Tuesday) to 30 May (Tuesday) 2023.

Please note that we are seeking comments on the VPA, not the related Planning Proposal (for which the exhibition process has concluded).

As such, any comments relating to the Planning Proposal will not be considered as part of this exhibition.

Please note all comments may be made available or reproduced in Council reports unless specifically requested by the submitter that this is not to occur.

Where a political donation has been made, please complete an electronic Political Donations and Gifts Disclosure Form.

It is common practice in the planning system to allow proponents (applicants) to view and respond to feedback received.
